TERMS AND CONDITIONS

1. INTRODUCTION

a. These Terms and Conditions govern access to and use of the Bolt91 online store and the purchase, booking and test-riding of products offered through it. b. The Bolt91 Store is operated by Blue Bolt Electric Private Limited, trading under the brand name Bolt91.

In these Terms and Conditions, “Bolt91”, “we”, “us” and “our” refer to Blue Bolt Electric Private Limited. “Customer”, “you” and “your” refer to any person accessing the store, submitting an enquiry or test-ride request, placing an order or purchasing a product. e. By accessing the store, submitting an enquiry or test-ride request, placing an order or making a payment, you agree to these Terms and Conditions, together with our Privacy Policy, Warranty Policy, Shipping and Delivery Policy, and Cancellation, Returns and Refund Policy.

2. ELIGIBILITY

a. You must be at least 18 years old and legally competent to enter into a contract to place an order. b. If a product is intended for use by a minor, the order must be placed by a parent or legal guardian. The parent or legal guardian will remain responsible for ensuring the safe and lawful use of the product. c. You agree to provide accurate, complete and current information while placing an order or submitting an enquiry or test-ride request.

3. PRODUCTS AND OEMS

a. Bolt91 is an authorised multi-brand sales and service partner. b. Products and components displayed on the store are manufactured by their respective Original Equipment Manufacturers, referred to as OEMs. c. Product specifications, battery capacity, range, charging time, speed, colours, images, features and warranty details are based on information provided by the respective OEM. d. Minor differences may exist between product images displayed on the store and the actual product. Product colours may also appear differently depending on the customer’s screen and display settings. e. Bolt91 reserves the right to update product information when revised information is received from an OEM.

4. PRODUCT RANGE AND PERFORMANCE

a. Any stated riding range, charging time, speed, load capacity or other performance figure is indicative and is based on the testing conditions specified by the respective OEM. b. Actual performance may vary depending on rider weight, payload, riding speed, terrain, gradients, tyre pressure, weather, battery condition, charging practices, riding mode and maintenance. c. Normal variations in range, charging time, speed or performance arising from usage conditions will not by themselves be treated as a product defect.

5. PRODUCT SELECTION AND CONFIGURATION

a. Customers are responsible for reviewing and confirming the selected product, model, variant, colour, battery, configuration, accessories, pricing and suitability before making payment. b. For configured or customised products, the specifications recorded in the final order will be treated as the customer’s confirmed selection. c. Bolt91 will not be responsible for an incorrect selection made by the customer where the product supplied matches the confirmed order.

6. PRICING AND TAXES

a. All prices displayed on the store are in Indian Rupees. b. Applicable GST, delivery charges, accessories, registration expenses, insurance, finance charges or other charges will be shown separately wherever applicable. c. Bolt91 may revise product prices and offers at any time before an order is confirmed. d. A price change will not affect an order already confirmed and paid for, except where an adjustment is required because of a change in tax or applicable law. e. In the event of an obvious technical or pricing error, Bolt91 may contact the customer before processing the order. f. If Bolt91 cannot fulfil an order at an incorrectly displayed price, the customer will be offered the option of paying the corrected amount or receiving a refund of the amount already paid.

7. OFFERS AND PROMOTIONS

a. Cashback, discounts, complimentary accessories and other promotional offers are subject to the stated validity period, eligibility requirements, product applicability and offer conditions. b. Unless expressly stated otherwise, separate offers cannot be combined. c. Bolt91 may withdraw or modify an offer before an eligible order is placed. d. An offer validly applied to a confirmed order will not be withdrawn retrospectively.

8. ORDERS AND ACCEPTANCE

a. Placing an order or making a payment constitutes an offer by the customer to purchase the selected product. b. An order will be treated as accepted when Bolt91 confirms the order and begins processing it for delivery. c. An automatically generated order acknowledgement or payment confirmation does not by itself guarantee product availability. d. Bolt91 may decline or cancel an order if: i. The product is unavailable. ii. The payment is unsuccessful, reversed or suspected to be fraudulent. iii. Customer information is incomplete or incorrect. iv. An incorrect price or product detail was displayed because of a technical error. v. The delivery location cannot be serviced. vi. Processing the order would violate applicable law. e. If Bolt91 cancels a paid order for any of the reasons stated above, the amount received will be refunded through the original payment method.

9. PAYMENTS

a. Payments must be made through the payment methods available on the store. b. Payment processing may be handled by third-party banks, payment gateways or financial service providers. Their respective terms, security checks and processing timelines will apply. c. Bolt91 does not store complete card details, UPI PINs, banking passwords or similar confidential payment credentials. d. An order will be processed only after successful payment confirmation unless Bolt91 has expressly approved another payment arrangement. e. The customer is responsible for ensuring that payment information is accurate and that the payment method is lawfully authorised for use.

10. EMI AND FINANCING

a. EMI amounts displayed on the store are indicative calculations only. b. Approval of any loan, EMI or finance facility is entirely at the discretion of the concerned bank, lender or finance provider. c. Finance approval may be subject to eligibility, documentation, credit assessment, interest, processing fees, down payment and other conditions imposed by the finance provider. d. Bolt91 does not guarantee finance approval and is not responsible for a lender’s rejection, delay, charges or lending decision. e. The customer must review and accept the lender’s final terms before entering into a finance agreement.

11. CANCELLATION, RETURNS AND REFUNDS

a. Once payment has been made, the customer cannot cancel the order. b. Bolt91 does not accept returns or provide refunds for change of mind, incorrect selection or dissatisfaction unrelated to a verified defect. c. Where a product or component is found damaged or defective, Bolt91 will facilitate inspection and repair or replacement of the affected component in accordance with the applicable OEM warranty. d. The complete product will not be replaced where the issue can be resolved by repairing or replacing the affected component. e. Complete product replacement or refund will apply only where required under applicable law or where Bolt91 or the respective OEM determines that repair or component replacement is not reasonably possible. f. The detailed conditions are provided in the Cancellation, Returns and Refund Policy displayed on the store.

12. SHIPPING AND DELIVERY

a. Products available in stock in Varanasi will normally be delivered within 24 hours of order confirmation and successful payment. b. Products not available in stock in Varanasi will normally be delivered within seven days of order confirmation and successful payment. c. Delivery timelines are indicative and may be affected by product availability, transportation delays, holidays, weather, regulatory requirements or circumstances beyond Bolt91’s reasonable control. d. The customer must provide an accurate delivery address and ensure that the customer or an authorised person is available to receive and inspect the product. e. Bolt91 will contact the customer if there is likely to be a significant delivery delay. f. The detailed conditions are provided in the Shipping and Delivery Policy displayed on the store.

13. INSPECTION AT DELIVERY

a. Customers should inspect the product at the time of delivery. b. Any visible damage, missing item, incorrect product or material discrepancy must be recorded and reported immediately to the Bolt91 delivery representative. c. Signing a delivery acknowledgement without recording visible damage may be treated as confirmation that the product was received in externally acceptable condition. d. Acceptance at delivery does not affect a valid claim relating to a hidden manufacturing defect discovered later.

14. OWNERSHIP AND RISK

a. Risk of loss or physical damage passes to the customer upon delivery and acceptance of the product. b. Ownership passes to the customer after Bolt91 has received full payment, subject to any separate rights held by a bank or finance provider under an EMI, loan or hypothecation arrangement.

15. REGISTRATION, INSURANCE AND LEGAL USE

a. Where registration, insurance, licence, helmet use or any other legal requirement applies to a product, the customer is responsible for complying with it unless Bolt91 has expressly agreed to arrange a particular service. b. The customer must use the product in accordance with applicable traffic laws, OEM instructions, safety requirements and permitted load and usage conditions. c. The customer must not use a product on public roads where such use is legally restricted. d. The customer is responsible for ensuring that the person operating the product is legally eligible and physically capable of doing so.

16. TEST RIDES

a. Test rides are subject to product availability, confirmation by Bolt91 and compliance with safety instructions. b. A person taking a test ride must: i. Provide accurate identification and contact information. ii. Hold a valid driving licence where legally required. iii. Wear the required safety equipment. iv. Follow the route and instructions specified by Bolt91. v. Operate the vehicle responsibly and lawfully. c. Bolt91 may refuse or discontinue a test ride where the activity is considered unsafe or unlawful. d. The rider will be responsible for loss or damage caused by deliberate misuse, reckless conduct or violation of instructions.

17. WARRANTY

a. Warranty on products and individual components is provided by the respective OEM and is subject to the OEM’s warranty period, coverage, exclusions and claim procedure. b. Bolt91 will assist customers in processing eligible warranty claims, but final approval of repair or replacement may be subject to inspection and authorisation by the respective OEM. c. Warranty may not cover normal wear and tear, accidental damage, misuse, unauthorised modification, overloading, improper charging, water damage, neglect or failure to follow the OEM’s instructions. d. Customers should review the warranty details displayed on the individual product page before making a purchase. e. The detailed conditions are provided in the Warranty Policy displayed on the store.

18. REPAIRS AND AFTER-SALES SUPPORT

a. Repairs, servicing or replacement outside warranty coverage may be chargeable. b. Estimated repair costs and timelines may be provided after inspection. c. Where an OEM must supply a part or approve a repair, the completion timeline will depend on the OEM’s response and availability of the required part. d. Customers should not allow unauthorised persons to open, alter or repair batteries, motors, controllers, wiring or other electrical components, as this may affect product safety and warranty coverage.

19. ACCESSORIES

a. Accessories may be subject to separate warranty and compatibility conditions. b. Customers should confirm accessory compatibility before purchase. c. Installation, modification or use of an incompatible or unauthorised accessory may affect product performance, safety and warranty coverage.

20. CUSTOMER COMMUNICATIONS

a. By providing a mobile number, email address or WhatsApp number, the customer authorises Bolt91 to send transactional communications relating to enquiries, test rides, orders, payments, delivery, warranty and service support. b. Promotional communications will be sent subject to applicable consent requirements. c. Customers may opt out of promotional communications through the method provided in the communication. d. Transactional messages necessary to process an active order, delivery, warranty claim or service request may continue even after a promotional opt-out.

21. PERSONAL INFORMATION

a. Bolt91 may collect and process personal information for responding to enquiries, arranging test rides, processing orders and payments, delivering products, providing support, preventing fraud and complying with applicable law. b. Personal information will be handled in accordance with the Privacy Policy displayed on the store and applicable Indian data-protection law.

22. ACCEPTABLE USE OF THE STORE

a. Customers and visitors must not:

i. Use the store for any unlawful or fraudulent activity.

ii. Submit false or misleading information. iii. Attempt unauthorised access to the store, Admin panel, database or another person’s information. iv. Introduce malware, automated scraping tools or disruptive code. v. Interfere with the security or operation of the store. vi. Copy or commercially exploit store content without permission. vii. Place fraudulent, speculative or abusive orders. b. Bolt91 may restrict access or cancel affected transactions where misuse is suspected.

23. INTELLECTUAL PROPERTY

a. The Bolt91 name, logo, store design, text, graphics, photographs and other original content are owned by or licensed to Blue Bolt Electric Private Limited. b. OEM brand names, logos, product images and product information belong to their respective owners and are used for authorised sales and informational purposes. c. No store content may be copied, reproduced, modified, distributed or commercially used without the permission of the relevant rights holder.

24. THIRD-PARTY SERVICES AND LINKS

a. The store may use or link to third-party services, including payment gateways, lenders, WhatsApp, maps and OEM websites. b. Bolt91 is not responsible for the independent content, availability, security or practices of a third-party platform. c. Use of third-party services may be subject to their own terms and privacy policies.

25. LIMITATION OF LIABILITY

a. To the maximum extent permitted by law, Bolt91 will not be liable for indirect, incidental, special or consequential loss arising from use of the store or a product, including loss of income, opportunity, data or business. b. Bolt91 will not be responsible for loss or damage caused by: i. Misuse, negligent operation or unlawful use of a product. ii. Failure to follow safety, charging or maintenance instructions. iii. Unauthorised repair, alteration or accessories. iv. Normal battery degradation or wear and tear. v. Incorrect information supplied by the customer. vi. Third-party payment, finance, communication or delivery services. vii. Events beyond Bolt91’s reasonable control. c. Where liability cannot legally be excluded, Bolt91’s liability will be determined in accordance with applicable law. d. Nothing in these Terms and Conditions excludes liability for fraud, wilful misconduct, gross negligence or any consumer right that cannot lawfully be waived.

26. INDEMNITY

a. To the extent permitted by law, the customer agrees to indemnify Bolt91 against losses, claims or expenses resulting from unlawful use of the store or product, deliberate misuse, fraudulent conduct, infringement of third-party rights or a material breach of these Terms and Conditions. b. This provision does not apply to losses caused by Bolt91’s own breach, negligence or misconduct.

27. FORCE MAJEURE

a. Bolt91 will not be responsible for delay or failure caused by circumstances beyond its reasonable control. b. Such circumstances may include natural disasters, flooding, fire, epidemic, government restrictions, strikes, transportation disruption, supply-chain interruption, network failure or OEM delay. c. Bolt91 will make reasonable efforts to inform affected customers and complete the order when normal operations resume.

28. CHANGES TO THESE TERMS AND CONDITIONS

a. Bolt91 may update these Terms and Conditions to reflect changes in its operations, products, technology or applicable law. b. The updated version will be published on the store with the revised effective date. c. Changes will apply prospectively and will not unfairly alter the essential commercial terms of an order already confirmed.

29. SEVERABILITY

a. If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions will continue to apply. b. The invalid provision will be interpreted or limited to the minimum extent necessary to make it lawful and enforceable.

30. WAIVER

a. Failure by Bolt91 to enforce any provision on one occasion will not constitute a permanent waiver of that provision or any other right.

31. GOVERNING LAW AND DISPUTE RESOLUTION

a. These Terms and Conditions are governed by the laws of India. b. The parties should first attempt to resolve any dispute by contacting Bolt91 and allowing a reasonable opportunity for resolution. c. Subject to applicable consumer-protection law and the jurisdiction of competent consumer commissions, disputes will be subject to the jurisdiction of the competent courts in Varanasi, Uttar Pradesh. d. Nothing in this provision restricts a consumer from approaching a consumer commission, court or authority having jurisdiction under applicable law.

32. GRIEVANCE REDRESSAL

a. Customers may raise complaints relating to orders, payments, delivery, warranty, privacy or use of the store with the following Grievance Officer:
